The New Patriotic Party (NPP) is defending Kpandai MP Matthew Nyindam as he seeks Supreme Court intervention to overturn a High Court judgment that nullified his 2024 parliamentary victory.

According to the NPP’s Director of Legal Affairs, Gary Nimako Marfo, the High Court’s decision represents a “substantial miscarriage of justice” that must be rectified.

Speaking on Joy FM’s Top Story on Monday, December 1, Mr. Nimako argued that the Tamale High Court, Commercial Division, committed a fundamental jurisdictional error by hearing a petition filed out of time.

He explained that the National Democratic Congress (NDC) filed its petition on January 25, well beyond the mandatory 21-day statutory deadline triggered after the publication of the election gazette.

“Matthew Nyindam has suffered a substantial miscarriage of justice before the court, and the Supreme Court must correct this injustice,” Gary Nimako stated.

He added that the High Court ought not to have heard the case, let alone delivered judgment or ordered a rerun.

The High Court in Tamale had earlier nullified Mr. Nyindam’s parliamentary victory and ordered a rerun of the Kpandai election, citing alleged irregularities.
Mr. Nyindam subsequently filed an application at the Supreme Court seeking to quash the High Court’s ruling.

The NPP believes the apex court will restore his seat, arguing that the initial petition was procedurally defective and therefore void.
